A Training for Prosecutors and Victim Advocates

This training will review the Americans with Disabilities Act, examining various legislative and practical issues related to working with victims with disabilities throughout the criminal justice process, as guided by compliance with state and federal Civil Rights obligations.

Through the course of the day, participants of this training will have the opportunity to: 

  • Examine Federal and State Civil Rights obligations as they pertain to cases as they move through the criminal justice system.

  • Review and have the opportunity to ask questions about the Americans with Disabilities Act and its implications for prosecution and supporting crime victims.

  • Consider various legal issues that may arise in the course of a prosecution including protecting mental health records, competency issues, accommodation requests, and V.R.E. 804a and 807.

  • Consider a recent Vermont case and learn from other's experiences working with a deaf victim.

  • Explore options to provide access and accomodations for victims with disabilites within the criminal justice process.

  • Consider practical strategies that may be helpful when working with a victim with disabilities.

  • Discuss the favorable outcomes for victims, advocates and prosecuters when members of the team are able to communicate well and share expertise throughout the criminal justice process to assure meaningful victim participation.
